Loss of Earning Capacity

When an employee sustains a permanent nonschedule injury causing the employee to require permanent physical or psychological work restrictions and he or she is unable to return to his or her previous occupation a loss of earning capacity may result. The extent of the loss must be determined by a vocational expert. The vocational expert will take into consideration education, work history, training, age and whether the employee can be retrained or vocationally rehabilitated.
