Safety Violations and Disfigurement Payments
An employee may be eligible for benefits if he or she sustains a permanent disfigurement that causes potential loss of wages. This could include a permanent limp sustained as a result of a work injury.

If an employer fails to comply with any state statute or any administrative rule of the Department of Workforce Development and if the violation is a substantial factor in causing a compensable injury, the employer must pay a 15% penalty to the injured employee in the form of increased disability and death benefits. The amount is based on the amount of "primary" compensation paid by the insurance carrier.
